Court hears arguments over license plate NASHVILLE State lawyers argued Thursday that pro-abortion advocates haven't tried hard enough to get their own license plate so the courts shouldn't tamper with 1 the "Choose Life" tag or Tennessee's specialty plate program. The American Civil Liberties Union has sued the state, saying the Legislature gave anti-abortion advocates a state forum with the plate. The ACLU contends the state's "issue advocacy" is trampling free speech rights because those with pro-abortion viewpoints haven't been given a license plate. "What you have here is a very public forum and it seems to be somewhat official," said attorney Ted Carey, representing the ACLU's case.
Both sides presented arguments Thursday in federal court. U.S. District Judge Todd Campbell said he might issue a decision on the case this week. From The Associated Press HECTOR IS COMING! Offer expires Cleanup fund for gas, oil tanks is bankrupt; buyout proposed NASHVILLE The state program that pays for cleaning up leaky underground oil and gas tanks is bankrupt and hasn't paid some of its bills in nearly a year, prompting Gov. Phil Bredesen to propose a taxpayer bailout of the fund. The state Department of Environment and Conservation to says it has not been charging companies enough to buy into the cleanup fund, which operates 1 like an insurance program.
For just $125 per year, tank owners get reimbursed up to $1 million to repair clean up spills and leaks and another $1 million to cover legal damages. The fee hasn't been raised since the early 1990s, the agency said. Now the program faces roughly $20 million in past due bills and is $11.7 million in the hole. To rescue the cleanup program, Bredesen has included $10 million in his budget proposal this year. "We took on an obligation as state government and didn't charge nearly enough in fees to fulfill that obligation," he told The Associated Press.

to be paid for cleaning up spills in the past year, said Karen H. Stachowski, deputy, commissioner for environment at the DEC. There are 48,067 tanks in the state, of which are old, rusty leaking gas or oil into some, area groundwater. Sometimes leaks, or accidental spills, can end up in drinking water wells. The federal Environmental Protection Agency has said petroleum tanks are among the nation's biggest polluters of underground drinking water.
Stachowski said part of the problem is that oil companies, gas stations and others who pay into the program aren't being charged enough by the state. The DEC told lawmakers earlier this month that it wants to increase the annual fee for registering a tank. Another proposal would increase the deductible paid for cleaning up a spill. Stachowski said meetings are scheduled for next week to hammer out a solution. The state program spent more than $8 million last year cleaning up shoddy or leaky underground tanks. According to the EPA, average per-tank cleanup costs run about $150,000. Federal regulators, who approve state cleanup programs, are keeping a close eye on Tennessee's bankrupt fund. "If their situation got so bad that they would not be able to address high priority sites, that would be a major concern of EPA," said John Mason, with the agency's regional Atlanta office.
